Thank you for choosing Protomate, home to the world's smart helmet. We value your enthusiasm and aim to provide a rewarding shopping experience through the Protomate Store.As with any shopping experience, there are terms and conditions that apply to transactions at a Protomate Store.

No Returns Policy

We have a strong belief that you'll be delighted with your Protomate Store purchases. We dedicate ourselves to crafting products tailored to your needs. It's important to note that we do not have a return policy in place. Nevertheless, we recognize that occasionally a product may not meet your expectations. In such rare circumstances, please take a moment to review the following terms concerning product returns.

Additional Protomate Product Terms 

Any alterations made to the software on a Protomate Product without proper authorization are in violation of the Protomate software license agreement. If your Protomate becomes inoperable due to an unauthorized software modification, the warranty will not cover the repair.

Pricing and Price Reductions/Corrections

Protomate reserves the right to adjust the prices of products displayed on the Protomate Store and website at any time and to rectify pricing errors that may occur unintentionally. In the event of a pricing error, we will notify you of the discrepancy and offer you the choice to proceed with the transaction at the corrected price or cancel your order at no cost to you.The prices displayed are in Thai Baht. If you're using an international Visa, MasterCard, or American Express credit card for payment, please note that fluctuations in exchange rates may impact the purchase price. Your bank or credit card issuer may also apply foreign conversion charges and fees, which could increase the total cost of your purchase. We recommend contacting your bank or credit card issuer to understand these potential fees.

Order Acceptance/Confirmation

Protomate reserves the right to refuse, limit, or cancel orders at its discretion. Upon receiving your order, we'll send an email confirmation, but this doesn’t indicate acceptance or confirmation of our offer to sell. We may require additional information before processing. We retain the right to accept or decline orders for any reason. If an order is canceled after billing, a refund will be issued for the amount billed.

Shipping & Delivery

Once products depart our facilities, various external factors beyond our control can affect their delivery, and Protomate isn't responsible for any delivery delays. The estimated shipment date accounts for factors like product availability, payment processing, and warehouse time but excludes transit duration. We initiate payment processing upon receiving all necessary details and full payment. If payment isn't received within 10 calendar days, your order may be affected. Please note: Protomate has a strict no-return policy on all purchases.

In-Store Pickup

Protomate provides an in-store pickup option for several items available on the Online Store. However, certain products and payment methods may not be eligible for in-store pickup. Only you or an individual authorized by you may collect the purchased item(s). A government-issued photo ID and the order number will be necessary for pickup. Once your order is ready, we will notify you and provide the deadline for item collection. Additionally, we'll send you one or more reminders as a helpful prompt. 

Consumers Only

Protomate exclusively sells and ships products to end-user customers. Purchasing products for resale is not permitted, and we retain the right to decline or cancel your order if we suspect it is intended for resale.

Thailand Sales Only

Products bought through Protomate's webiste or via our Contact Center are limited to delivery addresses within Thailand. Items from the Protomate Store won't be shipped to international addresses. Freight forwarder deliveries are not supported. Additionally, all our products adhere to Thai and global export control standards, ensuring proper handling in buying, selling, and transport activities.

Product Availability and Limitations

Due to the high demand and potential supply limitations of some of our products, Protomate might need to restrict the number of items available for acquisition. Protomate reserves the right to modify the quantities accessible for purchase at any given time, even following the receipt of an order. There might be instances where Protomate acknowledges an order but later finds it cannot fulfill the requested item. Should we be unable to provide a product you've ordered, Protomate will nullify the order and fully refund your payment.

Data Protection

Upon placing your order, you agree to allow us to store, process, and utilize the data collected from your order form based on our Privacy Policy. This includes potential transfer of data within the Protomate organization. You can request a written copy of the information we have about you. Please note, an administration fee might apply for handling such requests. If any information we hold about you is inaccurate, you can request corrections in writing.

Protomate One-Year Limited Manufacturer Warranty

Protomate offers a one-year limited manufacturer warranty for any new Protomate-branded product against defects stemming from materials or workmanship. You can find detailed terms and conditions for this warranty below and also inside the packaging of your Protomate hardware. The Protomate One-Year Limited Warranty does not cover products that aren't Protomate-branded, even if they are packaged or sold alongside Protomate items. Products not branded by Protomate might come with a warranty from their respective manufacturers. Please consult the product's packaging and accompanying documentation for more information.

Protomate One (1) Year Limited Warranty

For Protomate Branded Product OnlyIMPORTANT: BY USING YOUR UltraFusion-X1,M1 or PROTOMATE PRODUCT YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE PROTOMATE ONE (1) YEAR LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.Please refrain from using your product until you have reviewed the terms of the warranty. If you disagree with the warranty terms, kindly refrain from purchasing the product.

WHAT IS COVERED BY THIS WARRANTY?

PROTOMATE COMPANY LIMITED (“Protomate”) warrants the Protomate-branded UltraFusion-X1, UltraFusion-M1 hardware product and the Protomate-branded accessories contained in the original packaging (“Protomate Product”) against defects in materials and workmanship when used normally in accordance with Protomate published guidelines for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser ("Warranty Period"). Protomate published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications.

WHAT IS NOT COVERED BY THIS WARRANTY?

This Warranty does not cover any non-Protomate branded hardware products or any software, even if they come packaged or are sold with Protomate hardware. Manufacturers, suppliers, or publishers, other than Protomate, might offer their own warranties – we recommend contacting them for more details. Software distributed by Protomate, whether under the Protomate brand or not, is excluded from this Warranty. Please check the licensing agreement accompanying the software to understand your rights regarding its use. Protomate doesn't guarantee that the operation of the product will be without interruptions or errors. We are not liable for any damage resulting from not adhering to instructions related to the product's usage.

This Warranty does not apply: 

(a) Consumable components such as batteries or protective layers that naturally deteriorate over time, excluding degradation resulting from defective materials or workmanship; (b) Aesthetic damages like scratches, dents, or damage to ports, unless these issues are due to defective materials or craftsmanship; (c) Damages incurred from the use of third-party components or products that do not adhere to Protomate's specifications; (d) Damages resulting from accidents, mishandling, exposure to fire or water, natural calamities, or other uncontrollable external factors; (e) Damages due to using the product in a manner outside the guidelines provided by Protomate; (f) Issues arising from services, upgrades, or modifications carried out by unauthorized individuals not recognized as Protomate Authorized Service Providers; (g) Any modifications made to the product's functionality or features without explicit written consent from Protomate; (h) Normal wear and tear or issues inherent to the natural aging process of the product; (i) Situations where the product's serial number has been tampered with or removed; (j) Cases where Protomate is informed by relevant authorities or registries about a reported stolen product, or when the user fails to deactivate security features designed to prevent unauthorized access and cannot verify their ownership (for instance, by providing a receipt). In compliance with local regulations, Protomate may share hardware identification data from the product with respective authorities or databases for the purpose of security and preventing fraudulent activities.

IMPORTANT RESTRICTION FOR UltraFusion-X1, UltraFusion-M1 SERVICE.

Protomate may restrict warranty service for UltraFusion-X1 and UltraFusion-M1 to the country where Protomate or its Authorized Distributors originally sold the device.

YOUR RESPONSIBILITIES

You are advised to consistently back up the data on your Protomate product's storage media. This will protect your content and guard against potential operational disruptions. Before you receive warranty service, Protomate or its representatives may ask for proof of purchase details, seek information through specific questions to diagnose potential issues, and request compliance with Protomate's guidelines for obtaining warranty service. Prior to sending your Protomate Product for warranty service, it is recommended that you retain a separate backup of the storage media's contents, erase any personal information you wish to protect, and deactivate all security passwords.During the warranty service, the data on the storage media will be wiped and reformatted. Protomate and its representatives cannot be held accountable for the loss of software, data, or other information stored on the device being serviced.After receiving warranty service, your Protomate product, or its replacement, will be given back to you set to its configuration at the time of original purchase, incorporating any necessary updates. As part of this service, Protomate may apply updates to the system software that could hinder the product from returning to a previous software version. As a consequence, some third-party applications on your Protomate product may face compatibility issues or not function properly. It'll be your responsibility to manage and reinstall any other software, data, and personal information. Please understand that the restoration and reinstallation of non-Protomate software and data are not encompassed within this warranty. Post-warranty service, expect your Protomate product or its replacement to be handed back to you with its initial settings, but with potential software updates. During this service, Protomate could administer updates preventing the device from accessing older software versions. As a result, some third-party applications might not be compatible or operational. You'll be tasked with the reinstallation of your software, data, and other pertinent information. The warranty doesn't account for the recovery or reinstallation of external software, data, or details.

Important: Do not open the Protomate Product. Opening the Protomate Product may cause damage that is not covered by this Warranty. Only Protomate should perform service on this Protomate Product.

WHAT WILL PROTOMATE DO IN THE EVENT THE WARRANTY IS BREACHED?

If during the Warranty Period you submit a claim to Protomate in accordance with this warranty, Protomate will, at its option:(i) repair the Protomate Product using new or previously used Protomate genuine parts that have been tested and passed Protomate functional requirements,(ii) replace the Protomate Product with a replacement product of the same model (or with your consent a product that has the same or substantially similar features as the original product – e.g., a different model with the same features, or the same model in a different color) that is new or comprised of new and/or previously used Protomate genuine parts and has been tested and passed Protomate functional requirements.During servicing, Protomate might advise you to swap specific parts that you can install yourself. Any replacement part or product, especially those you've set up based on Protomate's guidelines, will carry forward the existing warranty or be covered for ninety (90) days from the date of substitution or repair, depending on which duration is longer for you. Once a product or part is exchanged or a refund is issued, the new item belongs to you, while the original or refunded one reverts to Protomate's ownership.

HOW TO OBTAIN WARRANTY SERVICE?

Prior to requesting warranty service, we recommend utilizing the online help resources mentioned below. If your Protomate Product continues to exhibit issues even after using these resources, kindly reach out to a Protomate representative. The representative will assess whether your product requires service and, if necessary, will guide you on the process. Please be aware that additional charges may apply based on your location when contacting Protomate via telephone.

WARRANTY SERVICE OPTIONS

Protomate will provide warranty service through one or more of the following options:

(i) In-store service. Bring your Protomate Product to any Protomate Store. Repairs might be conducted on-site, or your item might be sent to a designated repair center. Once the service is finished, you'll be informed, and you can collect your product from the same Protomate Store.

(ii) Mail-in service. If determined suitable for mail-in service, Protomate will provide prepaid waybills, and if needed, packing materials and comprehensive instructions on how to securely package and address your Protomate Product for shipment to our designated location. These guidelines might be provided via email or hard copy along with the packaging materials. Upon completion of the service, Protomate will dispatch the product back to you within Thailand only. Please note, shipping costs will be your responsibility to and from the designated location if the prescribed instructions for packaging and shipping the Protomate Product are strictly followed.Protomate reserves the right to modify the method by which Protomate may offer warranty service to you, as well as your Protomate Product’s eligibility for specific service methods. Service will be confined to the options accessible in the nation where service is sought. Service choices, parts accessibility, and response durations might differ based on the nation. Protomate might use Protomate Products or parts for service that originate from a different nation than the one from which the Protomate Product or original parts were sourced. You might be accountable for shipping and handling fees if the Protomate Product can't be serviced in its current location. If you pursue service in a nation different from the initial purchase location, you must adhere to all relevant import and export laws and stipulations and bear the costs for all customs duties, value-added taxes, and other related fees and charges. Where international service is an option, Protomate may repair or replace Protomate Products with equivalent products and parts that align with local standards.

LIMITATION OF LIABILITY

EXCEPT AS STATED IN THIS WARRANTY AND AS PERMITTED BY LAW, PROTOMATE IS NOT LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS; LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE. THIS INCLUDES DAMAGES FROM THE REPLACEMENT OF EQUIPMENT AND PROPERTY, COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE PROTOMATE PRODUCT, OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE PROTOMATE PRODUCT. THE ABOVE LIMITATION DOES NOT APPLY TO CLAIMS RELATING TO DEATH OR PERSONAL INJURY, OR ANY LEGAL LIABILITY FOR INTENTIONAL AND GROSSLY NEGLIGENT ACTS AND/OR OMISSIONS. PROTOMATE MAKES NO GUARANTEE THAT IT CAN REPAIR ANY PROTOMATE PRODUCT UNDER THIS WARRANTY OR REPLACE THE PROTOMATE PRODUCT WITHOUT RISKING OR LOSING INFORMATION STORED IN THE PRODUCT. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MIGHT NOT BE RELEVANT TO YOU.

GENERAL

No Protomate reseller, agent, or employee has the authority to make changes, extensions, or additions to this Warranty. If any provision is deemed illegal or unenforceable, it shall not affect the legality or enforceability of the remaining provisions. This Warranty is regulated by and interpreted according to the laws of Thailand where the Protomate Product was purchased. Protomate or its legal successor is the party providing the warranty under this Warranty.
